These Terms & Conditions apply to hannahivorybaker.com and to purchases made directly through the website from Hannah Ivory Baker.
Please read them before placing an order.

Nothing in these Terms & Conditions affects your statutory rights as a consumer.
1. Artwork
Unless otherwise stated, artwork offered for sale through this website is original work by Hannah Ivory Baker.
Every reasonable effort is made to describe artwork accurately, including its dimensions, medium and framing where applicable.
Because artworks are handmade and screens reproduce colour differently, the appearance of colour, texture and surface detail on your device may vary slightly from the physical artwork.
Frames are included only where this is stated in the artwork description.
2. Prices
Prices are shown in pounds sterling unless otherwise stated.
Any applicable taxes will be included or identified as required.
Delivery costs will be shown at checkout or agreed before purchase where a bespoke shipping quotation is required.
For international orders, customs duties, import taxes or other local charges may be payable following importation. Unless expressly stated otherwise, these are the responsibility of the recipient.
3. Orders
Submitting an order constitutes an offer to purchase the artwork subject to these Terms.
An electronic confirmation will be sent following an order.
As original paintings are unique objects, there may occasionally be circumstances in which an artwork has already sold but the website has not yet updated. If an artwork cannot be supplied after payment has been taken, you will be informed and refunded in full.
I reserve the right to cancel an order where there has been an obvious pricing or technical error. If payment has already been taken, you will receive a full refund.
4. Payment
Online payments are processed securely through Stripe.
Eligible customers may also be offered payment using Klarna or Clearpay.
Where Klarna or Clearpay is selected, the customer's agreement relating to instalments or deferred payment is with the relevant payment provider and is subject to that provider's own terms and eligibility requirements.
Squarespace confirms that Klarna and Clearpay are payment services rather than separate website payment processors and can be used with a Stripe-connected store.
Full payment must be received before an artwork is dispatched unless another arrangement has expressly been agreed in writing.
5. Delivery
Orders will be delivered to the address supplied during checkout or another address agreed in writing.
Please ensure that the delivery information provided is complete and accurate.
Estimated dispatch and delivery times are estimates unless a particular delivery date has expressly been agreed.
Larger or particularly valuable paintings may be sent using a specialist art courier.
You are responsible for ensuring someone is available to accept delivery where a signature or attended delivery is required.
Risk of loss or damage normally passes to a consumer when the artwork comes into the physical possession of you, or another person identified by you to receive it.
6. Cancellation and change-of-mind returns
If you are a UK consumer purchasing a standard, non-bespoke artwork online, you will normally have a statutory right to cancel your purchase without giving a reason.
The cancellation period ends 14 days after the day on which you, or a person nominated by you, takes physical possession of the artwork.

with a clear statement that you wish to cancel the purchase.
After notifying me of cancellation, the artwork should be returned within 14 days.
Unless otherwise agreed, you are responsible for the direct cost of returning an artwork where the return is simply because you have changed your mind.
The artwork must be packaged securely and I strongly recommend using an appropriately insured and trackable delivery service.
You are responsible for taking reasonable care of the artwork while it is in your possession. A deduction may be made where its value has been reduced because of handling beyond what would reasonably be necessary to inspect the work.
Where the statutory cancellation right applies, I will refund the price paid and the cost of the least expensive standard outbound delivery method offered.
Any additional cost resulting from your choosing an enhanced or expedited delivery service does not have to be refunded.
Refunds will be made using the original method of payment unless otherwise agreed and within the timeframe required by applicable consumer law.
7. Commissioned artwork
Commissioned paintings are made specifically for an individual client and will normally be governed by a separate written agreement confirming matters such as:
dimensions
subject or agreed brief
price
deposit and payment schedule
approximate timescale
delivery
any other agreed specifications
A statutory change-of-mind cancellation right does not normally apply once goods are genuinely made to an individual customer's specification or clearly personalised.
This does not affect your statutory rights where an artwork is faulty, damaged or materially different from what was agreed.
Any deposit or cancellation terms applying to a commission will be confirmed before work begins.
8. Damaged, faulty or incorrectly described artwork
Nothing in these Terms restricts your statutory consumer rights.
If an artwork arrives damaged, is faulty or you believe it differs materially from its description, contact info@hannahivorybaker.com as soon as reasonably possible.
Where possible, please retain all packaging and provide photographs showing:
the artwork
any damage
the packaging
the shipping container
This can assist with resolving the issue and making any claim against the carrier.
Where consumer law gives you a right to a refund, repair or other remedy, these Terms do not restrict that right.
9. Returning artwork
Before returning an artwork, please contact info@hannahivorybaker.com so appropriate arrangements can be agreed.
Where reasonably possible, artwork should be returned using its original protective packaging or packaging providing equivalent protection.
Please do not send valuable artwork using a service whose compensation limit is substantially below the value of the work.
10. Copyright
Purchase of an original artwork transfers ownership of the physical artwork only.
Copyright and all reproduction rights in the artwork remain with Hannah Ivory Baker unless expressly transferred by a separate written agreement.
Purchasing an artwork does not grant the purchaser the right to reproduce it commercially, create prints or merchandise from it, licence the image to others, or otherwise commercially exploit the image without written permission.
Images, photographs, written material, branding and other original content appearing on hannahivorybaker.com are also protected by applicable intellectual-property law and may not be reproduced commercially without permission.
11. Website content and availability
I take reasonable care to keep information on this website accurate and current but cannot guarantee that the website will always be uninterrupted or error-free.
The site may contain links to third-party websites or services. I am not responsible for the content, operation or policies of those third parties.
12. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
If you purchase as a consumer, I am responsible for foreseeable loss or damage caused by my breach of these Terms or failure to use reasonable care and skill.
I am not responsible for business losses incurred by a consumer, including loss of profit, revenue, commercial opportunity or business interruption.
13. Circumstances outside reasonable control
I will not be responsible for delays or failure to perform an obligation caused by circumstances genuinely outside my reasonable control.
If such circumstances affect an order, I will take reasonable steps to minimise the effect and contact you where appropriate.
14. Changes to these Terms
These Terms & Conditions may be updated occasionally.
The Terms applying to a particular purchase will normally be those in effect when the relevant contract was made, subject to changes required by law.
15. Governing law
These Terms are governed by the laws of England and Wales.
If you are a consumer living elsewhere in the United Kingdom or another country, nothing in this clause removes any mandatory consumer protections that apply to you under applicable law.
Cancellation form
You do not have to use this form, but you may use it to tell me that you wish to exercise a statutory right to cancel an eligible online purchase.
